Tharpe & Howell, LLP, recently defeated a putative nationwide class action lawsuit on behalf of a publicly traded manufacturing/distribution client. In March of 2016, the Firm’s client, a well known personal care products company, was hit with a class action lawsuit for alleged violations of consumer protection and warranty laws. The representative plaintiff (a resident of New York) claimed that, in 2012, she had purchased an electric heating pad manufactured by the Firm’s client which then burned her in November of 2015. Tharpe & Howell’s Coverage and Bad Faith Defense Team and Appellate Team achieved excellent results for an insurance carrier client when the California Court of Appeal upheld the previous granting of a Motion for Summary Judgment in an action alleging bad faith!
In the underlying case, an insured of GEICO Indemnity Company (the Firm’s client), was sued for causing an auto accident while operating a company vehicle on a personal errand, and the plaintiff obtained a judgment. Read More
